Les avoirs de Duvalier placés en Suisse ne peuvent pas (encore) être rendus à Haïti - Décision du Tribunal Fédéral

Dans un jugement rendu le 12 janvier 2010, le Tribunal fédéral suisse a invalidé la décision de l'Office fédéral de la justice (OFJ) de restituer à Haïti environ 5.7 million de dollars placés en Suisse par le clan Duvalier et qui restent bloqués depuis 1986. Cette décision a été motivée par l'absence de procédure pénale à l'encontre de la famille Duvalier en Haïti, principalement à raison de la prescription des faits.

La législation suisse permet d'engager des procédures de recouvrement des avoirs même en l'absence de décision condamnant l'auteur de l'infraction dans le pays d'origine (ou pays victime) si les valeurs patrimoniales en cause sont dans le pouvoir de disposition d'une organisation criminelle (articles 260ter et 70 du Code pénal suisse). Bien que le Tribunal Fédéral suisse n'ait pas exclu que la famille Duvalier avait agi comme une organisation criminelle, il a toutefois retenu que le délai de prescription pour l'infraction de participation à une organisation criminelle était déjà intervenu en 2001, soit 15 ans après la chute du régime de "Baby Doc" Duvalier en 1986 en Haïti .

En réaction à l'arrêt du Tribunal Fédéral, le Conseil Fédéral (Gouvernement suisse) a décidé de bloquer à nouveau les avoirs Duvalier sur la base de la Constitution. Cette décision est fondée sur le pouvoir discrétionnaire du gouvernement suisse en matière de politique étrangère. Par la suite, le Conseil fédéral a soumis au Parlement un projet de Loi fédérale qui devrait ultérieurement permettre de bloquer, de confisquer et de restituer les avoirs volés à des États défaillants comme Häiti.

Le jugement rendu par le Tribunal fédéral est évidemment déplorable. Il marque un contraste frappant avec les efforts déployés par la Suisse dans de nombreux autres cas pour restituer les avoirs illicites aux pays victimes, comme par exemple dans le cas Abacha (Nigéria).

Le Centre international pour le recouvrement des avoirs (International Centre for Asset Recovery -ICAR-) se félicite de la décision prise par le Gouvernement suisse et de ses efforts pour faire adopter une nouvelle législation en la matière. L'ICAR exhorte en outre, qu'une telle loi soit suffisamment étendue et adoptée rapidement par le Parlement.
